Latest Supreme Court decision on Christian Divorce
The Supreme Court bench of Chief Justice T S Thakur and Justice D Y Chandrachud, which was hearing a petition filed by Bengaluru-based octogenarian Catholic advocate Clarence Pais, who has sought legal sanctity for divorce decrees granted by church courts said on Monday(4/7/2016) that divorce decrees granted by ecclesiastical tribunals, popularly known among Christians as church courts, had no legal sanctity and anyone remarrying after such a divorce decree would be committing an offence.
The Supreme Court in its earlier ruling in Molly Joseph vs George Sebastian(1996) case had settled the issue on the authority of church courts.
